Terms of Service
Last updated: October 9, 2026
Service not available in comprehensively sanctioned jurisdictions (see §2). The operator's legal name and notice address are set out in §17.
1. Acceptance & binding agreement
These Terms of Service (the "Terms") form a legally binding contract between you and GachaBox (the "Service", "we", "our"). You accept these Terms by checking the consent box at checkout, by creating an account, or by using the Service. The consent box at checkout records the exact version of these Terms (by SHA-256 content hash), together with your IP address, user-agent, and timestamp, as evidence of your acceptance. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to create an account or make a purchase. By using the Service, you represent that you are 18 or older and have full legal capacity to enter into these Terms. You may not use the Service if you are located in, ordinarily resident in, or a national of a comprehensively sanctioned jurisdiction (including Cuba, Iran, North Korea, Syria, the Russian Federation, Belarus, or the Crimea, Donetsk, Luhansk, Kherson, or Zaporizhzhia regions of Ukraine), or if you appear on any US, UK, EU, UN, or Australian restricted-party list.
3. Account creation & responsibilities
One person, one account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate registration information (including a date of birth, used solely to verify the 18+ eligibility requirement and never sold or shared) and keep it current. Account sharing, account resale, multi-accounting, automated access (bots, scrapers), and circumvention of security or rate-limit controls are prohibited and are grounds for suspension or termination under our Acceptable Use Policy.
4. Digital content license
When you complete a purchase on GachaBox you receive a limited, non-exclusive, non-transferable, revocable license to access and use the associated digital content within the Service. You do not acquire ownership of any digital item, in-game account, virtual currency, or other content, and the price you pay is for that license — not for an ownership interest. Licenses may be revoked for violation of these Terms, for loss of upstream publisher access (see §9), or as required by law. Where the consumer-protection law of your jurisdiction grants you additional non-waivable rights, those rights are preserved (see §18).
5. Pricing, currency & taxes
All prices are stated and charged in United States dollars (USD). Your card issuer may apply foreign-transaction or currency-conversion fees outside our control. Where we are required to collect sales, use, value-added, or goods-and-services tax (US state sales tax, UK VAT, Australian GST, New Zealand GST, Canadian GST/HST), the applicable tax is calculated by Stripe Tax based on the billing address you supply and is shown before you confirm payment. Tax-inclusion behaviour by region and the limited circumstances in which a refund or credit is available are described in our Refund Policy.
6. Probabilistic mechanics & odds disclosure
GachaBox pulls are probabilistic. The approximate odds for each rarity tier are disclosed on the pull page before purchase and are honoured by the server-side draw engine. Outcomes are independent: past results do not influence future results. The pity mechanic (Vault Scroll eligibility) is deterministic, is disclosed alongside the odds, and resets on use. "Chase" tier outcomes are delivered like every other tier: the account's credentials are revealed in-app and remain available in your Collection. A Chase outcome awarded under our earlier Discord-delivery process is delivered via Discord using the contact handle you supplied at claim time. We do not guarantee the commercial value, future availability, or transferability of any digital item, and items have no real-world cash value provided by us.
7. Chargebacks & payment disputes
Before disputing any GachaBox charge with your bank, card issuer, or payment provider, you agree to first contact us in writing at disputes@gachabox.com and to allow fourteen (14) calendar days for us to investigate and respond. Many disputes (mistaken charges, duplicate authorizations, unrecognized descriptors) are resolved faster and more favourably this way than through a chargeback.
- Auto-suspension: when we receive a
charge.dispute.createdwebhook from our payment processor, your account is automatically suspended pending the outcome of the dispute. Suspended accounts cannot make purchases, claim items, or reveal credentials. - Lost dispute = item revocation. If a chargeback is decided against GachaBox, the digital items and account-claim rights associated with your account are revoked.
- Repeat chargebacks = permanent termination. Two lifetime chargebacks, or any chargeback we determine in good faith to be fraudulent, will result in permanent termination of your account and may be referred to fraud-prevention networks, our payment processor, or law-enforcement authorities.
- Compelling evidence: if you initiate a dispute, we will respond using the evidence we are required to retain (your acceptance of these Terms — hash, IP, user-agent, timestamp; reveal/claim audit log; prior undisputed transactions under Visa Compelling Evidence 3.0; 3-D Secure authentication results).
Nothing in this section limits your statutory consumer rights, your right to dispute a charge with your card issuer where required by law, or any non-waivable refund right described in §18.
8. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy, which is incorporated by reference. Prohibited conduct includes (without limitation): fraud, the use of stolen payment methods, false or abusive chargebacks, exploitation of bugs or odds, automation, scraping, multi-accounting, resale of accounts or items outside the Service, and harassment of other users or our staff. Reports of abuse may be sent to abuse@gachabox.com.
9. Third-party publisher rights
GachaBox is not affiliated with, endorsed by, or sponsored by any game publisher (including, without limitation, Com2uS Holdings Corporation and its affiliates) whose accounts or content may be made available through the Service. All third-party trademarks belong to their respective owners and are used only for referential identification. Digital content delivered through the Service may be subject to a third-party publisher's end-user licence agreement and may be suspended, reclaimed, banned, or terminated by the publisher at any time, for any or no reason, regardless of any payment you have made. We make no warranty of continued publisher access and you acknowledge that the risk of upstream loss-of-access is yours. See our IP & Publisher Disclaimer for DMCA / counter-notice procedure (17 U.S.C. §512) and trademark complaints.
10. Indemnification
To the maximum extent permitted by Applicable Law, you agree to defend, indemnify, and hold harmless GachaBox, its operator, and its agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms, the Acceptable Use Policy, or any applicable law; (b) your misuse of the Service; (c) any publisher-initiated claim, takedown, suspension, ban, or reclaim of an account or content delivered to you, including without limitation claims by Com2uS or any other upstream rights-holder for breach of their end-user licence; and (d) any chargeback or payment dispute later determined to be unjustified. This indemnity does not apply to the extent prohibited by the non-waivable consumer-protection law of your jurisdiction (see §18).
11. Limitation of liability
To the maximum extent permitted by Applicable Law, in no event will GachaBox or its operator be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to the Service or these Terms, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim relating to the Service or these Terms is capped at the greater of (a) the total amount you paid GachaBox in the thirty (30) days immediately preceding the event giving rise to the claim, or (b) USD $50.
Non-waivable consumer rights are expressly preserved. Nothing in this section excludes, restricts, or modifies any guarantee, warranty, right, or remedy that cannot lawfully be excluded under the law applicable to you, including (without limitation) the UK Consumer Rights Act 2015, the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010), the New Zealand Consumer Guarantees Act 1993, the California Consumer Legal Remedies Act, and §46 of the UK Consumer Rights Act 2015 in respect of damage to a device or other digital content. Where such law prohibits the exclusion of an implied condition or warranty, our liability is limited to the minimum extent permitted by that law.
12. Dispute resolution — arbitration & class waiver (US users)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. This Section 12 contains a binding individual-arbitration clause and a waiver of class, collective, and representative actions for users whose claims are governed by United States law.
Informal resolution first. Before commencing arbitration or filing a small-claims action, you and we agree to attempt to resolve any dispute informally for at least sixty (60) days after written notice describing the dispute and the relief sought is sent to the other party (to disputes@gachabox.com for notice to us, and to your registered email for notice to you).
Binding arbitration. If the dispute is not resolved informally, you and we agree to resolve it by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (current as of the date the demand is filed), as modified by these Terms. The Federal Arbitration Act (9 U.S.C. §§1–16) governs the interpretation and enforcement of this clause. The arbitration will be seated in [OPERATOR-FILL: home US county], and may proceed by telephone, video, or written submission at the consumer's election. Judgment on the award may be entered in any court of competent jurisdiction.
Class & collective-action waiver. Each party may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, mass, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Carve-outs. Notwithstanding the above:
- Either party may bring an individual action in small-claims court if the claim qualifies and remains in that court.
- Either party may seek injunctive or other equitable relief in court to protect its intellectual-property rights.
- California public-injunctive-relief carve-out (McGill rule). If you are a California resident, the arbitrator may not deny you the right to seek public injunctive relief under California law (e.g., CLRA, UCL, or FAL). To the extent any claim for public injunctive relief is found by a court of competent jurisdiction to be non-arbitrable under McGill v. Citibank, N.A., 2 Cal. 5th 945 (2017), that claim — and only that claim — will be severed from arbitration and heard in court, while all other claims proceed in arbitration.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice to disputes@gachabox.com within thirty (30) days after first accepting these Terms, stating your full name, registered email, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.
Severability of this section. If the class-waiver or any other part of this Section 12 is found unenforceable as to a particular claim or remedy, that part is severable and the remainder of Section 12 continues in force; if the class waiver itself is found unenforceable as to a class action seeking public injunctive relief in California, that action will proceed in court while individual claims proceed in arbitration.
Users in the United Kingdom, Australia, New Zealand, and Canada (English provinces and territories): nothing in this Section 12 prevents you from bringing a claim in the consumer courts or tribunals of your country of residence, or from referring a complaint to the Financial Ombudsman Service (UK), the Australian Financial Complaints Authority, the New Zealand Disputes Tribunal, or the equivalent consumer body in your province. Your statutory consumer-court and ombudsman rights are expressly preserved (see §18).
13. Governing law
These Terms are governed by, and construed in accordance with, the laws of the State of [OPERATOR-FILL: home US state] and applicable United States federal law, without regard to its conflict-of-laws rules. This choice of law does not deprive you of the protection of the mandatory consumer-protection law of your country or province of residence; where that law is more favourable to you and cannot be derogated from by agreement, that law applies to the extent it conflicts with this section.
14. Severability & survival
If any provision of these Terms is held invalid, illegal, or unenforceable, the provision will be enforced to the maximum extent permitted, or — if it cannot be — it will be severed and the remaining provisions will remain in full force and effect. The sections governing License (§4), Chargebacks (§7), Indemnification (§10), Limitation of Liability (§11), Dispute Resolution (§12), Governing Law (§13), and Notices (§17) survive termination of these Terms or your account.
15. Force majeure
Neither party is liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, war, terrorism, civil unrest, labour disputes, government action or sanction, network or telecommunications failure, hosting-provider outage, payment-processor outage, third-party publisher action (including reclamation of accounts), pandemic, or other events of force majeure.
16. Changes to these Terms
We may update these Terms from time to time. The current SHA-256 content hash and effective date of each legal document are exposed in our legal-document registry. When the bundle hash differs from the hash you most recently accepted, you will be re-prompted at your next checkout and must re-accept the updated bundle before continuing. Material changes will additionally be notified by email to your registered address. Continued use of the Service after a material change has taken effect constitutes acceptance of the updated Terms.
17. Notices
Notices to you may be given by email to your registered address, by in-Service notice, or — for legal process — by any method permitted by Applicable Law. Notices to us must be sent in writing to the operator at:
[OPERATOR-FILL: legal name — see operator-checklist.md][OPERATOR-FILL: notice address — registered-agent or PO box]

Disputes: disputes@gachabox.com
DMCA agent / copyright: our Discord
Privacy: privacy@gachabox.com
Abuse: abuse@gachabox.com
The arbitration venue and governing law are set out in §12 and §13, respectively.
18. Regional rights
The following subsections summarise non-waivable consumer rights that apply to you if you are a consumer in the relevant jurisdiction. Where these rights conflict with any other provision of these Terms, these rights prevail to the extent of the conflict.
18.1 United Kingdom — Consumer Rights Act 2015
If you are a UK consumer, you have non-waivable statutory rights under the Consumer Rights Act 2015 (CRA 2015), including that the digital content we supply is of satisfactory quality (s.34), fit for a particular purpose made known to us (s.35), and as described (s.36). Where those rights are not met, the remedies hierarchy in ss.42–44 applies (repair or replacement first, then a price reduction up to a 100% refund). You also have the right under s.46 to compensation for damage to your device or other digital content caused by our digital content where we have not used reasonable care and skill. These rights cannot be excluded under s.47 and are preserved in full, notwithstanding §11 above. Nothing in these Terms limits your right to bring a claim in the courts of the United Kingdom.
18.2 Australia — Australian Consumer Law
Our goods and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth), ss.54–62), including guarantees as to acceptable quality, fitness for a disclosed purpose, correspondence with description, and supply of services with due care and skill. For a major failure with the service, you are entitled to cancel your contract with us and obtain a refund for the unused portion or compensation for its reduced value, and to compensation for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.
18.3 New Zealand — Consumer Guarantees Act 1993 & Privacy Act 2020
If you are a New Zealand consumer, the Consumer Guarantees Act 1993 (CGA) provides guarantees of acceptable quality, fitness for purpose, correspondence with description, and reasonable care and skill that cannot be excluded as against a consumer (s.43). Where there is a failure of substantial character (s.21), you may reject the supply, obtain a refund, or claim damages. Nothing in these Terms excludes or modifies your rights under the CGA or the Fair Trading Act 1986. We comply with the Privacy Act 2020 and its Information Privacy Principles, including IPP 3A (effective 1 May 2026), which requires us to notify you when we collect your personal information indirectly (for example, from a fraud-prevention or KYC provider). Privacy concerns may be raised first with us at privacy@gachabox.com and, if unresolved, escalated to the Office of the Privacy Commissioner (privacy.org.nz).
18.4 Canada (English provinces and territories) — PIPEDA & CASL
If you reside in an English-language province or territory of Canada (BC, AB, SK, MB, ON, NB, NS, PE, NL, NT, YT, NU), the Personal Information Protection and Electronic Documents Act (PIPEDA) governs our collection, use, and disclosure of your personal information; residents of British Columbia and Alberta may also rely on their provincial Personal Information Protection Acts and the offices of their respective Information and Privacy Commissioners. Our marketing communications comply with Canada's Anti-Spam Legislation (CASL): we send commercial electronic messages only with your express or implied consent, identify the sender, and include a working unsubscribe link processed within 10 business days. Privacy access, correction, or complaint requests may be sent to privacy@gachabox.com.
18.5 California — CLRA & AB 2426 digital-goods disclosure
If you are a California consumer, your rights under the California Consumer Legal Remedies Act (Civ. Code §§1750–1784), Unfair Competition Law (Bus. & Prof. Code §17200), and False Advertising Law (Bus. & Prof. Code §17500) are preserved. Pursuant to California AB 2426 (Bus. & Prof. Code §17500.6, effective 1 January 2025): the words "buy", "purchase", and similar terms used in connection with digital content on the Service refer to the acquisition of a revocable licence, not ownership. Access to that digital content may be revoked under these Terms (see §4 and §9). California residents also have the right to seek public injunctive relief under McGill v. Citibank, N.A., 2 Cal. 5th 945 (2017); the carve-out in §12 preserves that right.
