IP & Publisher Disclaimer / DMCA

Last updated: May 6, 2026

This page sets out our position on third-party intellectual-property rights, the risk allocation for upstream publisher action, and the formal procedures for copyright (DMCA) and trademark complaints. It is incorporated by reference into our Terms of Service; §9 and §10 of the Terms apply alongside this page.

1. No affiliation

GachaBox is an independent marketplace. We are not affiliated with, endorsed by, sponsored by, or otherwise associated with Com2uS Holdings Corporation, Com2uS Co., Ltd., the publishers of Summoners War: Sky Arena or Summoners War: Chronicles, or any other game publisher whose accounts or in-game content may be made available through the Service. References to publisher-owned games, characters, units, or brands on the Service are descriptive identifications of items being offered, not statements of partnership.

2. Trademark acknowledgment

All third-party trademarks, service marks, logos, character names, unit portraits, and other source identifiers — including without limitation Summoners War, Sky Arena, Chronicles, and the Com2uS word and design marks — remain the property of their respective owners. Our use of those marks is limited to descriptive identification of items offered on the Service (nominative fair use) and does not imply any endorsement, sponsorship, or licence by the trademark owner.

3. Publisher EULA risk — please read carefully

The digital content sold or delivered through GachaBox — including in-game accounts, account credentials, characters, virtual currency, and item bundles — is produced and operated by a third-party publisher under that publisher's own End User License Agreement ("EULA"). The publisher, not GachaBox, controls the underlying game service. The publisher's EULA typically permits the publisher, at any time and without notice, to:

  • terminate, reclaim, ban, suspend, or restrict access to any account;
  • revoke or modify in-game items, virtual currency, achievements, or progression;
  • prohibit account transfers, account sales, third-party trading, or use of items obtained from third-party marketplaces;
  • pursue civil or criminal remedies against parties believed to have violated the EULA, including buyers and resellers.

GachaBox makes no warranty of continued publisher access. We do not control the publisher; we cannot prevent the publisher from reclaiming an account, banning the buyer, or otherwise terminating access; we have no obligation to compensate you if the publisher does so. By purchasing through the Service, the buyer acknowledges and accepts the risk of upstream publisher action fully and irrevocably as part of the bargain.

The disclaimer in this section does not exclude any warranty or remedy that cannot lawfully be excluded under the consumer-protection law applicable to you (UK CRA 2015, Australian Consumer Law, NZ CGA 1993, California CLRA, etc.). See Terms §11 and §18 for the rights expressly preserved.

4. Buyer indemnity for publisher-initiated claims

To the maximum extent permitted by Applicable Law, the buyer agrees to indemnify GachaBox and its operator against any claim, demand, suit, loss, or expense (including reasonable legal fees) brought by a publisher and arising out of the buyer's acquisition or use of digital content delivered through the Service — including without limitation reclamation of an account, allegation of EULA violation, claims of tortious interference, allegations of circumvention under 17 U.S.C. §1201, and Computer Fraud and Abuse Act claims. This indemnity is a substantive condition of every purchase and is in addition to the indemnity in Terms §10, not a substitute for it. It does not apply to the extent prohibited by the non-waivable consumer-protection law of the buyer's jurisdiction.

5. Designated agent for DMCA notices (17 U.S.C. §512(c)(2))

GachaBox has designated the following agent to receive notifications of claimed copyright infringement under the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512:

Name: [OPERATOR-FILL: DMCA agent legal name — see operator-checklist.md]
Address: [OPERATOR-FILL: DMCA agent service address — registered agent or PO box, NOT a home address]
Contact: our Discord
Phone: [OPERATOR-FILL: DMCA agent phone — landline or VoIP number for the registry]

The operator must register this agent with the United States Copyright Office DMCA Designated Agent Directory (dmca.copyright.gov) before relying on the §512(c) safe harbour. Registration is $6 and must be renewed every three years.

6. Format of a DMCA takedown notice (17 U.S.C. §512(c)(3))

To be effective, a notification of claimed copyright infringement under §512(c)(3) must be a written communication that includes substantially the following:

  1. A physical or electronic signature of the person authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed (or, for multiple works at a single online site, a representative list).
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit GachaBox to locate the material — typically the URL on gachabox.com.
  4. Information reasonably sufficient to permit GachaBox to contact the complaining party: name, address, telephone number, and (if available) email address.
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

Send notices via our Discord, or by post to the designated agent in §5. Knowingly materially misrepresenting that material is infringing exposes the complaining party to liability for damages under §512(f), including costs and reasonable legal fees.

7. Format of a counter-notice (17 U.S.C. §512(g)(3))

If you believe content of yours was removed or disabled by mistake or misidentification, you may submit a counter-notice. To be effective, a counter-notice must be a written communication to our designated agent that includes substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which GachaBox may be found), and that you will accept service of process from the person who provided the takedown notice or an agent of that person.

On receipt of a valid counter-notice we will forward it to the original complainant and, unless the complainant files an action seeking a court order against you within ten (10) business days, we will replace the removed material or cease disabling access to it not less than ten and not more than fourteen business days after receipt of the counter-notice, in accordance with §512(g).

8. Repeat-infringer policy

GachaBox terminates, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We treat two (2) or more validly processed DMCA takedown notices against the same user — that is, notices that comply with §512(c)(3) and that are not successfully countered under §512(g) — as the threshold for repeat-infringer status. Repeat-infringer accounts are permanently terminated and the user's email address and IP address are added to our signup block list. This policy applies regardless of any other enforcement steps under the Acceptable Use Policy.

9. Trademark complaints (separate channel)

Trademark complaints are not handled under the DMCA process. To allege that a listing or other Service content infringes your trademark rights, email trademark@gachabox.com (or reach us on our Discord) with: (a) the registered or common-law mark and the registration number where applicable; (b) the goods/services for which the mark is registered; (c) the URL of the alleged infringement; (d) a clear description of the complaint; (e) your authority to act for the trademark owner; and (f) contact details. We respond to well-formed trademark complaints within ten (10) business days.
